MINUTES CITY COUNCIL MAY lA, 2003 Mr. 1Vloutour introduced the following resolution and moved its adoption: RES`O7_UTION NO. 2003-5-99 -TABLING ACTION ON THE RENEWAL OF THE HISTORICAL SOCIETY GAMBLING ],ICENSE UNTIL, TILE MAY 28, 2003 COUNC;17. MEETING The foregoing resolution was duly seconded by Bleseuer. Ayes (5) Montour, Blesener, Anderson, LaValle, Fahey. Nays (0). Resohrtion declared adopted. SHERMAN The City Administrator presented an amended Right of Entry Agreement DEVELOPMENT related to Sherman Associates' townhome project at Rice Street and UPDATE Little Canada Road. It was noted that it is necessary for the Economic Development Authority to act on this agreement. Mr. Blesener introduced the following resolution and moved its adoption: RESOL UTION NO. 2003-.i-100 - TEMPORARIL Y ADJO URNING AS THE CITY COUNCI/_ AND CONVENING AT THE ECONOMIC DEVELOPMENT A UTHORITY The foregoing resolution was duly seconded by Fahey. Ayes (5) Bleseuer, Fahey, Montour, LaValle, Anderson. Nays (0). Resolution declared adopted. The City Administrator indicated that the amended Right of Entry Agreement will allow Sherman Associates to begin grading, utility, footings, and foundation work ou their townhome project prior to finalization of the Development Agreement. The City Administrator indicated that the Development Agreement is being tied to the commercial development at the northeast corner of Rice Street and Little Canada Road. It is necessary to ensure that the commercial development proceeds in order to make the tax increment-financing package work. Anderson questioned the developer's ability to sell townhomes until such time as the ,Development Agreement is finalized and the property transfer can take place. The City Administrator suggested that the City could stipulate that no sales contracts can be f nalized until the Development Agreement is approved.
