MINUTES <br />CITY COUNCIL <br />MAY lA, 2003 <br />Mr. 1Vloutour introduced the following resolution and moved its adoption: <br />RES`O7_UTION NO. 2003-5-99 -TABLING ACTION ON THE <br />RENEWAL OF THE HISTORICAL SOCIETY GAMBLING ],ICENSE <br />UNTIL, TILE MAY 28, 2003 COUNC;17. MEETING <br />The foregoing resolution was duly seconded by Bleseuer. <br />Ayes (5) Montour, Blesener, Anderson, LaValle, Fahey. <br />Nays (0). Resohrtion declared adopted. <br />SHERMAN The City Administrator presented an amended Right of Entry Agreement <br />DEVELOPMENT related to Sherman Associates' townhome project at Rice Street and <br />UPDATE Little Canada Road. It was noted that it is necessary for the Economic <br />Development Authority to act on this agreement. <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />RESOL UTION NO. 2003-.i-100 - TEMPORARIL Y ADJO URNING AS <br />THE CITY COUNCI/_ AND CONVENING AT THE ECONOMIC <br />DEVELOPMENT A UTHORITY <br />The foregoing resolution was duly seconded by Fahey. <br />Ayes (5) Bleseuer, Fahey, Montour, LaValle, Anderson. <br />Nays (0). Resolution declared adopted. <br />The City Administrator indicated that the amended Right of Entry <br />Agreement will allow Sherman Associates to begin grading, utility, <br />footings, and foundation work ou their townhome project prior to <br />finalization of the Development Agreement. The City Administrator <br />indicated that the Development Agreement is being tied to the commercial <br />development at the northeast corner of Rice Street and Little Canada <br />Road. It is necessary to ensure that the commercial development proceeds <br />in order to make the tax increment-financing package work. <br />Anderson questioned the developer's ability to sell townhomes until such <br />time as the ,Development Agreement is finalized and the property transfer <br />can take place. The City Administrator suggested that the City could <br />stipulate that no sales contracts can be f nalized until the Development <br />Agreement is approved. <br />
