MINUTES <br />CITY COUNCIL <br />AUGUST 27, 2003 <br />pointed out that the developer has had many months to bring the Final Plat <br />into conformance with staff recommendations, and she felt he has not <br />done his homework. Allen pointed out that it has been two months since <br />the Planning Commission acted on the Final Plat, and the developer has <br />had that amount of time to revise the Final Plat to conform to the <br />recommendations. Allen pointed out that the developer has had over a <br />year to obtain pipeline easement releases from Williams Pipeline, and he <br />has not done this. Allen indicated that the Watershed has been more than <br />willing to work with the developer, and it was only just this past Monday <br />that the developer met to review the Final Plat. Allen felt that enough was <br />enough. <br />Dan Arcand, Viking Drive, pointed out the repeated meetings that <br />neighbors have attended on this development proposal, and the <br />developer's request to again table the matter. Arcand stated that he had <br />better things to do than to continue to attend these meetings, and asked the <br />Council to act on the matter this evening. <br />There was no one else from the general public present wishing to <br />comment on this matter. <br />Upon motion by LaValle, seconded by Fahey, the public hearing was <br />closed. <br />Montour pointed out that the recommendations of City staff and the <br />Planning Commission and the direction given by the Council when acting <br />on the Preliminary Plat have not been incorporated into the Final Plat <br />before the Council for consideration. Montour stated that, as a result, he <br />could not vote to approve the Final Plat. <br />Fahey agreed. He indicated that he has been on the City Council for over <br />20 years and has tried to work with developers. It has been his experience <br />that developers will make a good faith effort to work from Preliminary <br />Plat to Final Plat incorporating the recommendations of the City's staff <br />and consultants and the conditions set by the Council. However, given the <br />large number of deficiencies in this Final Plat and the major changes that <br />have been made to the Final Plat, Fahey felt the Final Plat should be <br />denied. <br />Blesener agreed that the Final Plat contains major changes from the <br />Preliminary Plat. He also noted that the developer has failed to address a <br />number of issues in the Final Plat. Blesener pointed out the elevation <br />changes, the addition of retaining walls and the guardrail along the <br />proposed street. <br />11 <br />
