MINUTES <br />CITY COUNCIL <br />AUGUST 27, 2003 <br />Fahey asked if Von Riedel was suggesting that the City Engineer directed <br />him to put in the retaining walls. Von Riedel indicated that the City <br />Engineer said that the steep slope could not be adjacent to the street. Von <br />Riedel indicated that the remedy to that position was to install retaining <br />walls. Von Riedel stated that there is not a lot of variation in grades and <br />that neither the vertical nor the horizontal layout of the development <br />proposal have changed much. <br />The City Administrator indicated that there are grade changes of between <br />two and three feet on some of the lots. The City Engineer reported that in <br />comparing the Preliminary Plat with the Final Plat there are two to three <br />foot differences in grades along Preserve Court. The City Engineer <br />indicated that another option that lessens the slopes other than the <br />proposed retaining walls would be to lower the street. <br />Von Riedel indicated that given the City's requirement for a road <br />connection to Viking Drive, Preserve Trail is proposed and crosses the <br />Williams Pipeline. The grades at which the streets are proposed relate to <br />the amount of cover needed over the pipeline. <br />The City Engineer pointed out that the pipeline could be moved. Von <br />Riedel responded that that would be a major undertaking. <br />Anderson pointed out the Watershed's letter dated July 17, 2003 indicates <br />that a permit has not been issued for this project, and the letter goes on to <br />list the reasons why the permit has not been issued. Anderson stated that <br />in reviewing these issues, they do not appear to him to be minor as has <br />been presented by Von Riedel. <br />The City Administrator indicated that it is his understanding that the <br />developer leas made some revisions to the Final Plat in response to the <br />Watershed's concerns. However, the revisions have not been submitted to <br />the City, and are not reflected on the June 12, 2003 Final Plat that is <br />before the Council this evening. The Administrator pointed out that the <br />project keeps changing. <br />Fahey pointed out that this is an environmentally sensitive area. The <br />grades proposed in the Final Plat have changed by as much as three feet, <br />there are issues with encroachment into the no disturb area, there are <br />significant retaining walls being proposed, and the number of lots <br />proposed is not appropriate. Fahey pointed out that eliminating Preserve <br />Trail, shortening the cul-de-sac, and reducing the number of lots to ten <br />would lessen the environmental impact on the area. Fahey stated that he is <br />aware that developers want to maximize the number of lots, but this <br />doesn't change the fact that the proposed Final Plat is significantly <br />
