MINUTES CITY COUNCIL NOVEMBER 2G, 2003 3165/3167 information. SPRUCE STREET - Mr. Blesener introduced the following resolution and moved its adoption: VALOR RESOL UTION NO. 2003-11-270 - TA73LING ACTION ON THE AMENDMENT TO CONDITIONAL. USE PERMIT AND VARIANCE FOR 3165-3167 SPR UCE STREET, VALOR ENTERPRISES, PENDING A RECOMMENDATION FROM THE PLANNING COMMISSION. The foregoing resolution was duly seconded by LaValle. Ayes (5) Blesener, LaValle, Fahey, Montour, Anderson. Nays (0). Resolution declared adopted. AMENDMENT Mayor Fahey opened the public hearing to consider an amendment to TO ZONING to the Zoning Code relative to accessory and principal buildings. Fahey CODE - noted that the Planning Commission has recommended approval of the ACCESSORY amendment. & PRINCIPAL BUILDINGS There was no one from the general public present wishing to comment on this matter. Upon motion by Fahey, seconded by Anderson, the public hearing was closed. The City Planner indicated that the proposed amendment clarifies the definitions of accessory use/building and principal use building as well as establishes single-family dwelling performance requirements. Mr. LaValle introduced the following resolution and moved its adoption: RESOLUTIONNO. 2003-11-271-AMENDING SECTION 902 OF THE LITTLE CANADA CITY CODE ADDRESSING ACCESSORY USE/7UILDING AND PRINCIPAL. USE/BUILDING DEFINITIONS AND ESTA737.LSHINCi b7N(i7_E-I'AMII_Y DWELLING PERFORMANCE REQUIREMENTS The foregoing resolution was duly seconded by Montour. Ayes (5) LaValle, Montour, Anderson, Blesener, Fahey. Nays (0). Resolution declared adopted. Anderson noted the moratorium that is in place relative to this matter. The City Attorney noted that the moratorium ordinance contained an expiration date and recommended that it be allowed to expire on its own. 2
