MINUTES <br />PLANNING COMMISSION <br />MAY 28, 2003 <br />I{nudsen pointed out that it is in the City's best interests to facilitate the <br />development of the property to the west. The City can do this by <br />maintaining some level of control over Outlot A to ensure an equitable <br />solution for both the developer and the property owner to the west. <br />Knudsen felt that if the developer's primary concern is preserving the <br />character of the Hamel Estates neighborhood, an agreement could be <br />developed to address this concern. <br />Krengel felt that there was no need for the City's involvement in this issue <br />since the developer would only be able to sell Outlot A for what the <br />market will bear. At the time of sale, the developer could address the <br />issue of the caliber of house that would be built on the lot. <br />The City Planner disagreed, and pointed out that without the City's <br />involvement, the developer would have control over Outlot A and could <br />ask whatever price he wanted. <br />I{nudsen indicated that the City's primary objective would be to facilitate <br />the development of the property to the west. <br />Carlson suggested that the outlot be eliminated and the property added to <br />one of the adjacent lots. The Planner noted that the issue is the same for <br />the City, that is, the Iandlocking of the property to the west. The City <br />Administrator suggested that if Outlot A is added to one of the adjacent <br />lots, the issue of future subdivision of the property to facilitate the <br />development of the property to the west should be addressed in the <br />Development Agreement. The Planner suggested that the outlot could be <br />added to an adjacent lot and aright-of way easement taken over this area <br />to provide access for the property to the west. Carlson indicated that <br />without adding the outlot to the property to the west, that property would <br />not be large enough to subdivide. <br />Angie I{lidzejs, Twin Lake Road, questioned the location of the property <br />line that she shares with the Hamel property. The City Planner indicated <br />before the Hamel property can be platted, property lines would be verified <br />by both the title company and the surveyor to ensure that the plat as <br />proposed is correct. <br />I{nudsen suggested that in establishing a value for Outlot A for purposes <br />of compensating the developer, that value should include both a <br />proportionate cost for the street and utility improvements as well as a land <br />value. Knudsen felt that the City's taking control of the outlot would <br />ensure an equitable deal for both the property owner to the west and the <br />developer. <br />Krengel pointed out that the property owner to the west was contacted <br />about participating in the Hamel Estates development and declined.
