IVIINUTES
CITY COUNCIL
1~I~1Y I.4. 2003
The City Administrator indicated that Chis was a stafT~recommendation,
and the concern was with the aesthetics of a dry pond. The Administrator
recommended that if the decision is to allow a dry pond, that the
homeowners association doctunents be drafted acknowledging their
ownership of the pond as well as maintenance respa~sibilities.
Anderson pointed out that the townhome association would own the pond
and would be responsible for it, but the residents of the senior buildins~
twill have a view of the pond. Blesener suggested that the townhome y
association would have the ability to convert the pond to a wet pond, and
if the residents of the senior building felt strongly about it, they could
contribute toward the cost of maintaining a wet pond.
Fahey a~,reed that if the City wanted water maintained in the pond, this
was the time to require it. LaValle felt that it was up to the townhome
associations whether the pond was wet or dr}~. The City Administrator
suggested that the City could require the developer to escrow funds for a
period of five years to allora- for conversion of the pond to a wet pond. In
that way, if the matter becomes an issue within that time frame, the pond
could be converted to a wet pond. Fahey stated that he (il<ed this idea as it
I:ept options open.
N[r.
