The <br />applicant is proposing to subdivide the parcel into three lots, one of which would overlay <br />an existing residence. <br />The subject property is zoned R-1, Single Family Residential. <br />In 1986, the City approved an identical subdivision proposal for the property with a <br />condition that the existing house on the property be modified such that a minimum 10 <br />foot side yard setback would be maintained. Rather than modify the home as dictated <br />by the conditions of approval however, the applicant/homeowner chose not to modify <br />the residence and the subdivision approval was allowed to lapse. Because such <br />approval has lapsed, it is therefore considered null and void. <br />Attached for reference: <br />Exhibit A -Site Location <br />Exhibit B -Certificate of Survey <br />ISSUES ANALYSIS <br />Since the lapsing of the original subdivision approval, the City amended the Zoning <br />Ordinance to make a special setback allowance for homes constructed prior to 1980. <br />According to Section 905.050.C.2.a of the Ordinance: <br />
