MINUTES <br />PLANNING COMMISSION <br />SEPTEMBER 11, 2003 <br />VARIANCES - The Commission reviewed the request of Jim Cossack for variances <br />421 ELI ROAD - related to size and dimension for a recreational accessory building at <br />JIM COSSACK 421 Eli Road. It was noted that Mr. Cossack was not present at this <br />evening's meeting. Keis noted that the City Planner has pointed out in his <br />September 3, 2003 report that there are no hardships present to warrant <br />granting of the variances that have been requested. <br />Knudsen stated that there is no question that it would be difttcult to justify <br />granting the variances requested. Knudsen stated that it appears Mr. <br />Cossack has three options. Those are: <br />o Connect the recreation building to the house. It would then <br />be considered a part of the principal structure and would <br />require no zoning action other than the appropriate building <br />permits. <br />o Tear the recreation building down. <br />o Reduce the size of the recreation building to less than <br />160 square feet. <br />Knudsen pointed out that any of these options are available to Mr. <br />Cossack, and he will have to chose one of them. <br />Lorraine Pelton, 433 Eli Road, pointed out that Mr. Cossack began <br />construction of this accessory building without a building permit. She <br />reviewed the history of the previous Conditional Use Permit for three-car <br />garage that was granted to Mr. Cossack a couple of years ago. Pelton <br />indicated that the oversized garage was approved so that Mr. Cossack <br />could store his vehicles and other property inside. Pelton reported that <br />there has been no attempt by Mr. Cossack to use the garage for the storage <br />of his vehicles and property. Pelton asked what the garage is being used <br />for? <br />Pelton reported that when construction first began on the accessory <br />building, she called the City and learned that there was no building permit <br />for this building. Even though the City was notified repeatedly, <br />construction continued on the accessory building. <br />Keis reported that the City has been taking steps to stop the construction, <br />issuing violation notices and finally citations. Keis indicated that process <br />is underway and suggested that it will likely be decided by the courts. <br />Pelton reported that Mr. Cossack has ignored the City, and pointed out that <br />he is now constructing an 8-foot high fence.
