N11NUT[~s <br />CITI' COIiNCIL <br />APRIL 10, 200? <br />Rcc~ss <br />VOUCII~RS <br />CALL fOR <br />VACATION <br />HEARCNG - <br />coi,~n~ION <br />BOND <br />City abutting pipelines, and adopting such a setback would make these <br />properties non-conforming. <br />Tom Hartigan asked if this property would be considered a wetland <br />preservation area under the tax code. The City Attorney reported that his <br />research shows that there has never been a conservation delineation of this <br />property. "therefore, the property would not be considered a wetland <br />preservation area. <br />Hartigan suggested that if the City were to acquire the property according to <br />MN Code 273.1 I Subd. 1 1 the value of the property should be assessed at the <br />wetland value. The City Attorney replied that acquisition of property by a <br />State agency has to be at fair market value. While the property has enjoyed <br />tax-exempt status for several years, the County is reassessing the property and <br />changing Che status to taxable at the request of the property owner. The <br />County is also looking to collect back taxes on the property. The City <br />Attorney reported that while the City is obligated to pay fair market value for <br />the property, if the property is acquired through eminent domain, that value <br />will likely be determined by acourt-appointed board of commissioners or by a <br />jury. <br />Clly Lomark appeared before the Council and presented Barbara Allen and <br />Tom Hartigan with tokens of appreciation for the work they have done on this <br />issue on behalf of the neighborhood. <br />At this point in the meeting, 9:00 p.m., Council took a short recess. The <br />meeting was reconvened at 9:10 p. m. <br />Nlr.
