Hanson <br />At its September meeting, the Commission discussed whether or not it would be possible to ensure <br />that the exterior appearance of a "grist mill" house as proposed to be constructed by Kathy Smith <br />could be retained as such. It is my understanding that the City would have the ability to require the <br />retention of the exterior appearance of the "grist mill" house through a restrictive covenant agreement <br />that would be recorded against the property. This agreement would be recorded with Ramsey County <br />Property Records, and would put any future property owners on notice of this requirement. The <br />concern with this approach would be enforcement. It could be costly to ensure compliance with an <br />uncooperative owner. The other factor is that future Councils would have the ability to release the <br />covenant if they do desired. <br />Attached is my memo dated August 30'x' relative to City Staff's position on potential future uses of <br />the Noel Drive property. It would be my recommendation that the City retain the ownership of this <br />property based on these potential uses. One important use listed is the use of this property as a buffer <br />area between a commercial use and a residential neighborhood. The development of this property <br />with residential housing could result a situation of incompatibility between the two uses. <br />However, if the decision is to sell the property, it would be my recommendation that the property be <br />sold on the open market. I do not believe that the City should grant any one individual an advantage <br />over anyone else simply by the fact that they have submitted a unique proposal. <br />cc: Kathy Smith <br />
