M1NU'1'LS <br />PLANNING COMMISSION <br />FLB72UARY 14, 2002 <br />Keis pointed out to Roberto that the fact that there is no wetland on the <br />property takes away the hardship that would warrant granting the variance. <br />if there were wet(auds on the property which could not be disturbed, then <br />there would be the basis for a hardship. Keis pointed out that even though <br />there may be soils that are less than desirable, and there would be <br />additional expense to Roberto to construct a house in these soils, that is <br />not basis for granting a variance. <br />Roberto indicated that in applying for the variance, he felt that the less <br />than desirable soils and the fact that he would have to excavate these soils <br />out or install pilings would be justification for a variance. Keis pointed <br />out that this would not be a hardship that would justify the granting of a <br />variance. <br />The City Planner indicated that given there are no designated wetlands on <br />this lot, it is clearly possible to construct a house on the property and meet <br />setback requirements. "I'he issue is that there may be poor soils which will <br />increase construction costs. <br />Carol Stenger, property owner to the east, indicated that she has <br />designated wetland on her property. Stenger indicated that during wet <br />weather, there is standing water on the Roberto property. Stenger was <br />concerned that should Roberto fill his property, it would push additional <br />water onto her property. <br />Duray suggested that the City Engineer would have to review <br />development plans to ensure any development meets drainage <br />requirements. <br />Joe Buche, property owner to the south, stated that he opposed the <br />vacation or Rose Place. Buche felt that the placement proposed by Mr. <br />Roberto would bring the back of this house too close to his property. <br />Buche also suggested that there was peat under the high area where <br />Roberto is proposing to place his house. Therefore, Buche felt soils <br />corrections will be necessary no matter where Roberto places his house on <br />the property. <br />Keis asked if Rose Place ever would be improved through to Savage Lane. <br />T"he Planner indicated that the hill in the area probably precluded the street <br />from going all the way through. <br />Duray asked about the vacation being requested. The City Planner that <br />Rose Place has a 60-foot right-of=way. "I'he City's standard today is 50 <br />feet. "T'herefore, if the City chooses, it could reduce the right-of--way to 50 <br />
