Such ordinance changes have <br />rendered the subject use legally non-conforming. <br />The B-3 District is intended to provide for and limit the establishment of motor vehicle <br />oriented or dependent commercial and service activities. <br />The rezoning of the subject property to a B-2 designation would re-establish the subject <br />use a "conforming" usa anri i~ th. ~~ ci innnrhori by .v .r ..FF4.... <br />Conditional Use Permit Amendment <br />As mentioned previously, the applicant is proposing to construct a 2,000 square foot <br />(50' x 40') accessory building upon the subject property, To accommodate the building, <br />an amendment to the existing conditional use permit applied to the subject property is <br />necessary. <br />Plan Submissions. As shown on the submitted site plan, the proposed accessory <br />building is to be located directly north of the existing building. While the building meets <br />applicable setback requirements, it is lacking in some highly relevant information. <br />Based on the submitted site plan, it is unclear how the accessory building is to be <br />accessed and how it will relate to vehicular traffic patterns on the site. Additionally, no <br />information has been provided in regard to off-street parking, landscaping, lighting, <br />outside storage (locations) and drainage (from additional hard surface area). <br />Prior to the Planning Commission taking action on the request, it is recommended that <br />additional information be submitted regarding the aforementioned items. <br />Building Materials As shown on the submitted building elevations, the accessory <br />building is to be finished with 8" aluminum siding. A brick veneer has, however, been <br />proposed on the base of the rear elevation of the structure. <br />The acceptability of the building materials, particularly in relation to the materials used <br />on the principal building, should be subject to further City discussion. <br />Building Use. As an accessory structure, use of the proposed building will be limited to~ <br />activities which are customary and incidental to the principal use of the property. This <br />should be made a condition of condi#ional use permit amendment approval. <br />SUMMARY RECOMMENDATION <br />While our office believes the rezoning of the subject property to a B-3 zoning <br />designation (and the elimination of a nonconforming condition) is positive, we feel key <br />information is presently lacking regarding the conditional use permit amendment <br />request. <br />2 <br />
