MINUTES CITY COUNCIL DECEMBER 16, 2015 RIGHT-OF-WAY DEDICATION AT 3100 COUNTRY DRIVE The Administrator stated that the 3100 Country Drive right-of-way dedication had already been adopted in the consent agenda, but he would like a motion to reconsider this item in order to clarify some information. Upon motion by Montour, seconded by Keis, to reconsider action on the right-of-way dedication for 3100 Country Drive. Ayes (4). Nays (0). Motion passes. The Administrator stated that this property is the former public works building and will be sold soon. He explained that this property was created a long time ago, and the parcel still includes Country Drive and areas on both sides of the road, even though the building is only on the east side. He wants to clarify that everything to be sold is only on the east side of the east right-of-way line of Country Drive, and the property on the west side of Country Drive should be dedicated as Country Drive right-of- way. The City Planner has indicated that a subdivision is not necessary to complete a subdivision of this piece from the main parcel for the purpose of dedication. As the owner, the City council may describe the portion at issue, and take action with a majority vote. This needs to be done so the deeds are correct at the sale closing. Keis introduced the following resolution and moved its adoption: RESOLUTION NO. 2015-12-245 – CLARIFYING THE 3100 COUNTRY DRIVE PROPERTY TO BE SOLD IS ONLY ON THE EAST SIDE OF THE EAST COUNTRY DRIVE RIGHT-OF-WAY; AND APPROVING THE DEDICATION OF THE REMAINING 3100 COUNTRY DRIVE PARCEL ON THE WEST SIDE OF COUNTRY DRIVE AS ADDITIONAL COUNTRY DRIVE RIGHT-OF-WAY. The foregoing resolution was duly seconded by Montour. Ayes (4). Nays (0). Resolution declared adopted.
