<br /> <br /> STAFF REPORT <br /> <br /> <br /> <br />TO: Mayor Keis and Members of City Council <br /> <br />FROM: Heidi Heller, City Clerk <br /> <br />DATE: January 29, 2016 <br /> <br />RE: Accept Maintenance & Easement Agreement for the 716 Labore Road <br />Subdivision & Development <br /> <br /> <br />In February 2015, the City Council approved the subdivision of 716 Labore Road from one <br />single-family lot to two lots. The subdivision was approved with several conditions relating to <br />dealing with the existing and future drainage on this lot and surrounding lots. The developer <br />and property owner, Exceptional Homes by Design, has now submitted a Maintenance and <br />Easement Agreement for the city to accept and sign. The developer has been working with the <br />City Engineer since the approval and below is the engineer’s comment in regards to the <br />submitted Maintenance & Easement Agreement: <br /> <br />I have been working through all of our comments and requirements with the developer <br />including obtaining a drainage and utility easement across the property to the south for the <br />storm water discharge. Execution of this maintenance agreement is the last requirement. It <br />documents our requirements that it is the property owners are responsibility to maintain the <br />infiltration/pond area, the retaining wall, and the storm sewer outlet pipe since these <br />facilities accommodate only private stormwater. I would recommend the City execute the <br />agreement. <br />Staff recommends accepting the Maintenance and Easement Agreement as submitted by <br />Exceptional Homes by Design for 716 Labore Road. <br />
