301.3 Vacant structures and land.
All vacant structures and premises thereof or vacant land shall be maintained in a clean, safe,
secure and sanitary condition as provided herein so as not to cause a blighting problem or adversely
affect the public health or safety.
We could consider adding this type of provision in our codes. However, it may be too vague to be
enforceable. Another option would be to take another look at the entire International Property
Maintenance Code to see if it could address unresolved problems. Here is a link to the code:
https://law.resource.org/pub/us/code/ibr/icc.ipmc.2012.html

Recommendation:
The main issue we have had at the former Bally’s site is trash dumping. Our codes are adequate to
cover this type of situation. The real issue here is trying to prevent the dumping activity and that has
proven difficult. In terms of the A&W site, our existing codes probably are adequate to allow us to
address the primary concern (grass, trash, parking lot maintenance, and out-of-date signage. The City
Council will need to comment on whether or not they believe other issues need to be addressed that our
codes currently don’t speak to.
