The Planner also indicated that his other <br />recommendations stand as well. <br />Gatzke pointed out the safety issues involved with the location of the road <br />on the pipeline easement as well as the liability issues for the City in <br />replacing that road should Williams need to disturb it. <br />Roycraft asked about a legal interpretation of the enforceability of the <br />City's pipeline policy. The City Administrator indicated that the Council <br />will enforce the policy as enacted, and will defend that enforcement, if <br />necessary. <br />Duray indicated that he is opposed to the project. He reasons include the <br />many public safety issues that have not been answered relative to the <br />pipeline, his position that the project is too dense, and his feeling that this <br />is a very fragile area given it is adjacent to a wetland. Duray also <br />indicated that he did not support the connection of Preserve Trail to <br />Viking Drive since this connection created corner lots from existing <br />interior lots and would not be in the best interests of the property owners <br />affected. Duray also pointed out that it would be necessary to cross the <br />pipeline with Preserve Trail which is a public safety concern. Duray felt <br />the proposed development was not in keeping with the character of the <br />neighborhood and was not conducive to the area. <br />Roycraft recommended approval of the Preliminary Plat of The Preserve <br />development subject to compliance with the recommendations of the City <br />Engineer as outlined in his October 4, 2002 report, the recommendations <br />of the City Planner as outlined in his October 8, 2002 report, the <br />recommendations of the City Administrator as outlined in his September <br />18, 2002 e-mail, and subject to verification through title work of the <br />location of the Williams easement. <br />Motion seconded by Gatzke. <br />Motion carried 3 to 2.
