Stat. 645, et al. - Words and Interpretation <br /> <br />QUESTION: Can the City reduce its haulers from 3 to 1 under its organized collection <br />ordinance. <br /> <br />ANSWER: There appears to be no statutory guidelines or opinions addressing this question. <br />However, based on the provision of the Little Canada ordinance, it can be interpreted to allow a <br />reduction in haulers. <br /> <br />For purposes of guidance, Minn. Stat. 115A.94 allows cities to undertake organized <br />collection. Specifically 115A.94, Subd. 1 states: <br /> <br /> “Definition. “Organized collection” means a system for collecting solid waste in which <br />a specified collector, or a member of an organization of collectors, is authorized to <br />collect from a defined geographic service area or areas some or all of the solid waste <br />that is released by generators for collection.” <br /> <br />According to City records, organized collection was established by ordinance in 1989. <br />The City of Little Canada websites states: <br /> <br />“In an effort to meet the Minnesota State Legislature’s mandated waste abatement goals, <br />the City of Little Canada instituted organized collection of refuse in 1989. Under <br />organized collection, the city contracts with a specific hauler(s) for collection of <br />residential refuse and recyclables from all of our single family homes and duplex <br />dwellings. Each hauler is assigned to a specific area within the city for collection <br />services. Residents are required to use the hauler that is assigned to their area for refuse <br />and recycling collection services unless they qualify for an exemption.” <br /> <br />2
