<br /> <br /> STAFF REPORT <br /> <br /> <br /> <br />TO: Mayor Keis and Members of City Council <br /> <br />FROM: Bill Dircks, Public Works Director <br /> <br />DATE: April 22, 2016 <br /> <br />RE: Metropolitan Council Sanitary Sewer Turnback Easement Issues <br /> <br />The Metropolitan Council continues to try to clean up the title work for the easements associated with <br />the sanitary sewer interceptor it is turning back to Little Canada. In the course of recording a quit <br />claim deed for the easements it was discovered that the Certificates of Title for the properties on which <br />the easements are located do not show an interest of record owned by Metropolitan Council. There <br />was no deed found from the City of Little Canada conveying the easements to Met Council in 1970 <br />when the pipes were declared regional interceptors and were to be conveyed to Met Council. <br />In order to get the deed conveying the easements from Met Council to the City of Little Canada on <br />record with the Registrar of Titles, a quit claim deed from the City of Little Canada to Met Council has <br />been prepared to convey the easements on registered property. <br />Once that deed is recorded Met Council will immediately record another quit claim deed from Met <br />Council to the City of Little Canada conveying the easements back to the City. <br />It has been a long and complicated process but the Met Council representatives believe that this is the <br />last step that needs to be taken in order to close the transaction. <br />Staff recommends the City Council approve and sign the quit claim deed, which has been described <br />above.
