STAFF REPORT

TO: Mayor Keis and Members of City Council

FROM: Joel Hanson, City Administrator

DATE: June 17, 2016

RE: Amend May 25, 2016 Council Meeting Minutes

The minutes from May 25, 2016 had the incorrect early assessment payoff amount for Canabury
Square, unit #223. Also, Bob Hamper, the unit’s mortgage holder, has requested the City
remove the condition that the unit must be sold prior to being allowed to pay the assessment.
Mr. Hamper stated that they are committed to selling the unit, but he is concerned that the timing
of the closing could be after the November 15th deadline for the payoff. City Staff recommends
the condition that the unit must be sold prior to being allowed to pay off the assessment, be
removed from the resolution.

The current resolution reads:

RESOLUTION NO. 2016-5-91 –ALLOWING THE EARLY PAYOFF OF THE HIA
ASSESSMENT FOR UNIT #223 AT CANABURY SQUARE IN THE AMOUNT OF
$21,947.68 TO BE PAID BY NOVEMBER 15, 2016 WITH THE CONDITION THAT THIS
CAN OCCUR ONLY IN CONJUNCTION WITH THE SALE OF THIS UNIT, AS
PRESENTED BY THE CITY ADMINISTRATOR.

City Staff is recommending that the resolution be amended to read:

RESOLUTION NO. 2016-5-91 - ALLOWING THE EARLY PAYOFF OF THE HIA
ASSESSMENT FOR UNIT 223 at CANABURY SQUARE IN THE AMOUNT OF
$21,055.94 TO BE PAID ON OR BEFORE NOVEMBER 15, 2016 WITH THE
CONDITION THAT IF THE SALE OF THIS UNIT HAS NOT YET BEEN
COMPLETED PRIOR TO NOVEMBER 15, 2016, THAT THE PROPERTY WILL BE
CONTINOUSLY MARKETED UNTIL SOLD, AS PRESENTED BY THE CITY
ADMINISTRATOR.
