<br /> <br /> STAFF REPORT <br /> <br /> <br /> <br />TO: Mayor Keis and Members of City Council <br /> <br />FROM: Joel Hanson, City Administrator <br /> <br />DATE: July 8, 2016 <br /> <br />RE: Public Hearing - Vacate a Portion of 2935 Country Drive Right-of-Way <br /> <br /> <br />In 2006, Dick Biagini, owner of 2935 Country Drive, requested the City vacate a portion of <br />Country Drive adjacent to his property in order to have more land to install a monument sign. <br />The City Council approved the vacation of 11 feet of Country Drive right-of-way. City Staff <br />was recently contacted by Mr. Biagini because he is in the process of selling the property, and <br />after a survey was done, the surveyor noted that the legal description in the resolution vacating <br />the right-of-way was not correct. The City’s intent was to vacate the Westerly 11 feet, but the <br />resolution that was recorded with Ramsey Country stated the Easterly 11 feet. The attached <br />resolution states the correct legal description of the right-of-way area that is to be vacated, and <br />Mr. Biagini will be rededicating the easterly 11 feet back to the City. <br /> <br />City Staff recommends the Council approve the resolution vacating a portion of Country Drive <br />right-of-way as stated in the legal description below: <br /> <br />The westerly 11 feet of Country Drive lying between the easterly extension of the <br />northerly and southerly lines of Lot 1, Block 1, Country Side Terrace. <br /> <br /> <br /> <br />
