A <br />summary of the Supplemental Agreement is outlined below. <br /> <br />During the excavation process petroleum odors were noticed emanating from some of <br />the excavated material from the roadbed. These odors prompted additional site test pits <br />and on-site investigation to determine the source of the odors. It was determined that <br />there was a layer of what appeared to be oiled aggregate that existed under the old <br />roadbed. This oiled roadbed layer was separated from the bituminous surface by clean <br />aggregate base and was therefore not discovered during the pavement removal <br />process. This layer was also not detected in the initial County borings and was not <br />discovered until late in the storm sewer installation process. The material was laboratory <br />tested and the results were high in Diesel Range Organics (DROs) and therefore any <br />material excavated had to be treated as regulated fill and hauled off-site for proper <br />disposal at a landfill or used under hard surfaces within the project. As the road was <br />being lowered to accommodate an urban section there was limited ability to use the <br />material under the new hard surface areas and most of this material had to be hauled <br />and disposed of at an approved SKB landfill. Supplemental Agreement #2 addresses <br />payment for those additional costs. The proposed split for these costs is 89% County/ <br />11% City. <br /> <br />A copy of the Supplemental Agreement is included with this memo and at this time we <br />are requesting the City Council authorize approval.
