<br /> <br /> STAFF REPORT <br /> <br /> <br /> <br />TO: Mayor Keis and Members of the City Council <br /> <br />FROM: Jessica Jagoe, Associate Planner <br /> <br />DATE: November 21, 2016 <br /> <br />RE: Buck Blacktop Appeal <br />City staff met with Mr. Erdmanis on November 10, 2016 to discuss outdoor storage on the property at <br />32 S. Owasso Blvd. and possible solutions for obtaining compliance moving forward. Based upon the <br />discussion at the Council meeting, Mr. Erdmanis has indicated he understands the City’s position and <br />will discontinue the rental of outdoor storage to non-occupants of the building. He has indicated that <br />notice will be given the current tree contractor occupying the property and the four semi-truck owners. <br />A deadline was not provided as to when these agreements would terminate, but it would be staff’s <br />position that this cease by December 31st, 2016. Additionally, Mr. Erdmanis will provide the City with <br />a list of equipment that is no longer needed or operable for Buck Blacktop operations. This listing will <br />include a tentative schedule for removal of said items. <br />It is Mr. Erdmanis’s request that he be allowed to continue up to 135,000 square feet of outdoor <br />storage area. This is comparable to the amount of outdoor storage on the property in the 1990’s. <br />Given this use existed legally without a Conditional Use Permit it is hard to pinpoint an exact amount <br />that was present at the time of the rezoning of the property from I-1 to I-P in 1988. Staff feels this <br />square footage is reasonable and fair as to what probably existed at that time. <br />With regards to sub-contractors use of the outdoor storage area, Mr. Erdmanis would like to continue <br />this practice as it helps with the operations of Buck Blacktop. In our discussions with Mr. Erdmanis, <br />the concern for staff was distinguishing between non-occupant outdoor storage and sub- <br />contractor/partnered outdoor storage. Mr. Erdmanis has agreed that when it is needed for a sub- <br />contractor to store trucks, equipment, or materials on the property it could be verified through job <br />contracts. In addition, Mr. Erdmanis will make arrangements to provide an office area for the sub- <br />contractor when these partnerships are needed. Upon completion of the job, the sub-contractor <br />equipment would be removed. Between these two mechanisms, staff felt it would be possible to <br />verify. <br />If the Council feels the provisions outlined above are acceptable, staff will work with Mr. Erdmanis to <br />specify the listing of equipment slated for removal and a site plan showing the designated 135,000 <br />square foot outdoor storage area. Mr. Erdmanis had requested some flexibility with the site plan so <br />that he isn’t committed to exact locations of where equipment, materials or trucks will be stored. <br />However, staff would like some detail so that there is documentation in the file for future reference.
