C. SCHEDULE AND COMPENSATION: <br /> <br />1. Hours of Service. Services provided pursuant to this Agreement <br />shall be based upon 16 hours per week, on average (calculated on <br />services provided for each month this agreement is in effect). Hours of <br />service shall be scheduled at the JPL’s discretion, provided that said <br />hours will fall within the City’s normal business hours unless prior approval <br />is obtained by JPL from City. JPL shall also provide City with a schedule <br />of service availability for each month two weeks prior to the <br />commencement of said month. <br /> <br />2. The monthly fee for the services provided under this agreement <br />shall be $2,490. Said fee may be adjusted upon 30 days notice from Fire <br />Marshal to City, subject to City’s consent. Said fee is inclusive of all costs, <br />supplies, mileage, benefits, expenses, etc. and no additional charges shall <br />be made to City. Should the Fire Marshal wish to absent himself from <br />performance of the aforementioned duties to accommodate a vacation or <br />some other extended absence, the Fire Marshal shall provide reasonable <br />advance notice to the City of said request. The City agrees to reasonably <br />accommodate the Fire Marshal’s request, at the City’s sole discretion. <br />Payments to the Fire Marshal shall be adjusted to reflect the approved <br />absence. <br /> <br /> <br />D. EFFECTIVE DATE AND CONTRACT TERM: <br /> <br />1. Effective Date. This Agreement shall be effective February 1, 2017 and <br />shall continue in full force and effect until terminated pursuant to <br />paragraph 2 below. <br /> <br />2. Contract Term. This Agreement shall continue in full force and effect <br />until January 31, 2018. If neither party provides notice to the other of its <br />intent to cancel this Agreement at least thirty (30) days prior to its <br />scheduled expiration, the Agreement shall be automatically renewed for <br />an additional one-year term. <br /> <br />3. Early Termination for Incapacity. The Agreement may be canceled <br />prior to its scheduled termination by reason of the death or permanent <br />disability of JPL’s principal officer. A successor principal officer and the <br />City may agree to continue the agreement by executing a written <br />agreement to that effect within 15 days of the death or determination of <br />permanent disability. <br /> <br />4. Early Termination for Breach. If either party believes that the other is in <br />breach of this agreement, it shall deliver written notice to the allegedly <br />breaching party informing them of the nature of the breach. The notified <br />party may take action to cure the breach within five (5) business days of <br />receipt. <br />
