Comprehensive Environmental Response, Compensation, and Feasibility Act, and similar <br />Federal and State Statutes possessing the necessary permits and operated in compliance with <br />applicable environmental laws and regulations. Any deviation of this provision shall be <br />considered a violation and default of this Contract. The Contractor shall maintain actual <br />Ramsey/Washington RDF (Recycling and Energy Center – R&E Center) receipts and shall <br />provide the City with copies of such receipts. Estimated Little Canada tonnages shall be <br />reported to the City bi-annually. All costs associated with disposal (tipping fees) shall be <br />based upon fees net of any rebates that the Contractor may be eligible for, regardless of <br />when (or if) received by the Contractor. It shall be understood that the disposal rate in <br />Exhibit A shall be based upon the lowest available tipping fee charged by the RDF facility <br />to an entity that takes all material to the RDF facility for disposal. <br /> <br />j. Notification. If any resident of the City places any items out for pickup and the item is not <br />taken by the Contractor, the Contractor shall provide immediate written notification to the <br />resident and the City of reason(s) for refusal to pick up the item. Notification must be left <br />on the item(s) in question. Notifications left for a resident must be submitted to the City by <br />noon on the following day after collection was refused. <br /> <br />k. Exceptions for Handicapped and/or Disabled. The Contractor shall make reasonable <br />exceptions as to the manner of pickup for handicapped or disabled residents. <br /> <br />2. Yard Waste Collection. <br /> <br />a. Description. Yard waste collection service shall include the collection of all yard waste <br />from participating residential dwelling units in the City of Little Canada. Cost for this <br />service is described in Attachment “A.” <br /> <br />b. Containers. Residential dwelling units shall have their yard waste segregated from other <br />refuse in a container clearly identified as “Yard Waste” located at the boulevard adjoining <br />the curb on or before 7:00 a.m. on the designated day of collection. Up to two containers of <br />at least 90 gallon capacity will be provided by the contractor at no additional cost to the <br />resident. Additional compostable bags and/or clearly identified containers may also be <br />placed curbside at each pickup without limit to quantity at no additional cost. Containers <br />should not exceed 960- gallon capacity nor weigh more than 50 pounds when filled. <br />Bags should not be filled so as to exceed their structural capacity. <br /> <br />c. Frequency. Yard Waste Collection Service shall be provided from April 1st through <br />th November 30 , weather permitting each year and each residential dwelling unit shall have <br />its yard waste collected a minimum of once per week on the same day as refuse collection <br />service. <br /> <br />d. Reporting. Tonnages or yards of yard waste collected shall be reported to the City on an <br />annual basis b y January 22nd of the following year. <br /> <br />e. Conveyance of Yard Waste. The Contractor shall be responsible for the safe, legal, and <br />environmentally sound conveyance of all yard waste collected under this Contract. The <br />Contractor shall convey the yard waste to a lawfully approved compost site and shall <br />assume all liability and responsibility for materials deposited.
