1401. BURNING REGULATIONS <br /> <br /> <br />1401.010. PROHIBITED PERIODS. <br /> <br />(1) No persons shall kindle, ignite, set or start any outdoor fire for any purpose <br />whatsoever during any period which is designated by the City Council/ Fire Chief/designee or <br />Minnesota DNR as hazardous or dangerous. <br /> <br />(2) Periods designated by the City Council as hazardous or dangerous for outdoor fires <br />during which burning is prohibited shall be designated by resolution and a copy of such <br />resolution shall be published in the official City newspaper. (3) During prohibited periods, no <br />burning shall be done without first obtaining from the City Administrator, a permit and such <br />permit shall be countersigned by the Chief/designee of the Little Canada Volunteer Fire <br />Department. The permit shall designate the name and address of the person applying for same, <br />the name and address of the owner of the property upon which the burning is to be done, the <br />location by street address and legal description upon which burning is to be done, and the date <br />and time at which such fire shall be set. <br /> <br />1401.020. BURNING REQUIREMENTS. At any times other than periods during which <br />burning is prohibited without a permit as designated in Section 1401.010 hereof, no fires shall be <br />started for the burning of rubbish, brush, leaves, wood, paper, or other combustible material. <br />except as follows: <br /> <br />(1) Ordinary rubbish burning on residential property must be done in a burner which is <br />constructed so as to prevent flying ashes or embers. Such burners shall be located on <br />the owner's land in a place which will not constitute a menace or a nuisance to <br />neighbors or to their property. Such refuse burners may be ignited only between the <br />hours of 4:30 o'clock p.m. and 9:00 o'clock p.m. on any day. <br /> <br />(2) Any outdoor fire not in an incinerator, once kindled, must be kept under immediate <br />personal and constant supervision and control of the person starting such fire until it <br />is extinguished. <br /> <br />(3)(1) No leaves or other combustible material shall be burned nor shall any fires be started <br />on the surface of any bituminous, asphalt or oil-treated roadway at any time. <br /> <br />(4)(2) No fire of any kind shall be started or continued at such times or in such places as to <br />constitute a menace or danger to the property of others or to the property of the person starting <br />such fire. <br /> <br /> <br />(Source: Ord. 31, Amended: Ord. 67) <br />
