<br />9. Special Purpose Fences. <br />a. Fences for special purposes and fences differing in construction, height or length may <br />be permitted in any district in the City by issuance of a conditional use permit, except as <br />provided for in Section 903.020.F.9.b. of this Ordinance. <br /> <br />As a result, Mr. Anderson is seeking approval of a Conditional Use Permit to allow for a Special Permit Fence <br />up to eight feet tall along the east side of the property based on the condition set by the Council. The new fence <br />will be a solid vinyl maintenance free fence that is of a complimentary color to the building. <br /> <br />Staff feels that it is also better for Mr. Anderson to replace the entire fence along the east side of the property <br />given its current state, plus this creates a more aesthetically pleasing look for those residential properties. As <br />well, this section of fence on CVS Pharmacy’s property is visible as you drive between the two buildings to <br />access the drive-through. Given the agreement between the two owners for replacement, staff also recommends <br />a Conditional Use Permit Special Purpose Fence be approved for CVS Pharmacy up to eight feet tall on the east <br />side of the property for that northern 45 feet only. <br /> <br />With regards to placement of the fence along the north side of the property, there is no formal action that would <br />be needed in order for Mr. Anderson to proceed. The height and location of the fence comply with code <br />requirements and the original approval for providing the buffer area. The fence on the north side of the property <br />will also be the vinyl maintenance free solid fence to match the building. Mr. Anderson is not requesting to <br />increase the height of the fence on the north side given the grade difference. The existing fence is six feet and <br />he will be replacing at the same height. This was rather more informational because staff wanted the <br />neighboring owners to be aware of the fence replacement plans for the property as a whole. Installation of the <br />new fence would be subject to Section 903.020.F. <br /> <br />Recommendation <br />Planning Staff recommends approval of a Conditional Use Permit at 2680-88 Rice Street for an eight foot high <br />Special Purpose Fence as outlined above subject to the following conditions: <br />1. Fence installation is subject to city code requirements in Section 903.020.F. <br />Furthermore, Planning Staff recommends approval of a Conditional Use Permit at 2650 Rice Street for a 45 foot <br />section of an eight foot high Special Purpose Fence as outlined above subject to the following conditions: <br />1.
