<br /> <br /> STAFF REPORT <br /> <br /> <br /> <br />TO: Planning Commission Members <br /> <br />FROM: Jessica Jagoe, Associate Planner <br /> <br />DATE: May 4, 2017 <br /> <br />RE: Lot Line Adjustment – 2444 & 2446 McMenemy Street <br />Mark Chlebeck, Property Owner of 2446 McMenemy Street, has requested an adjustment to a side <br />property line shared by his lot and the neighboring property to the south at 2444 McMenemy Street <br />(Glenn Hageman, Property Owner). This adjustment would result in no net loss of land to either lot. <br />In fact, it’s an equal exchange of 156 square feet of land between the two. Additionally, the lot line <br />adjustment will result in a side lot line that is perpendicular to McMenemy Street and with this <br />adjustment the property line would now be parallel to the wall of the existing house, rather than <br />pinching in the setback at the rear and extending behind the house in the current condition. <br /> <br />It should be noted that this same lot line adjustment was approved in September 2003. Mr. Chlebeck is <br />the brother of the previous applicant from 2446 McMenemy and Mr. Hageman is the same owner. <br />Following the 2003 City Council approval, the applicants did not record the necessary paperwork with <br />Ramsey County. Given the documents were not recorded within twelve months from the date of the <br />approval, the approval is considered to have lapsed. Therefore, Mr. Chlebeck and Mr. Hageman are <br />again seeking approval of the side lot line adjustment. <br /> <br />Analysis <br />As indicated, the proposed property line adjustment would result in no net loss of land to either lot and <br />would result in a side lot line which is perpendicular to McMenemy Street. <br /> <br />According to Section 1003.020(d) of the Subdivision Ordinance, side lot lines should be at <br />approximate right angles to street lines. The proposed lot line adjustment would improve what could <br />be interpreted as a legal non-conforming condition and is therefore considered a positive change. <br /> <br />Setbacks <br />The proposed lot line adjustment does not appear to result in the creation of any non-conforming <br />setbacks. The certificate of survey submitted by the applicant will need to be updated to show the side <br />yard setback for Parcel A to the south property line. The existing house on Parcel B is roughly 85 feet <br />away from that northern property line. <br /> <br />Easements <br />City staff has directed the applicant that as part of this subdivision request, the City would require <br />dedication of the 6-foot drainage and utility easements around the perimeter of both parcels. Staff is <br />awaiting an updated certificate of survey and has made our approval recommendation subject to a <br />revised certificate being submitted.
