Resolution declared adopted. <br />VARIANCE- Fahey opened the continuation of Public Hearing to consider the request <br />SAVAGE LANE/ of Sam Roberto for a setback variance property located on the northeast <br />ROSE LANE - corner of Savage Lane and Rose Lane so that he can construct asingle- <br />SAM I20BERT0 family house and avoid poor soils on this property. It was noted that Mr. <br />Roberto is also requesting that the Council call for a vacation hearing for <br />vacation of a portion of the Savage Lane right-ofway as well as the north 10 <br />feet of Rose Lane. It was noted that the Planning Commission has <br />recommended denial of the variance request as there was no hardship present <br />to warrant granting the variance. 1=ahey also noted that the Planning <br />Commission did not have the benefit of the Braun lntertec report relative to <br />soil conditions on the property. <br />Sam Roberto appeared before the Council and reviewed his plan for <br />constructing a residential house on this property. He indicated that he is <br />requesting a 10-foot variance from the standard 30-foot setback to allow house <br />placement on the most suitable portion of the property. The variance would be <br />for the rear yard of the house as it lies in relation to Rose Lane. Roberto <br />reviewed his reasoning for the variance that would allow him to build on the <br />most stable, dry earth that is available on this lot. There will be some soils <br />replacement needed on the west portion of the lot, but a natural butler on the <br />eastern portion of the lot would be maintained from the adjacent wetland area. <br />Roberto then reviewed his reasons for avoiding construction on the eastern half <br />of the lot, pointing out that there are deep swamp deposits and a high ground <br />water table. He noted that there would need to be substantial fill brought into <br />this portion of the property in order to support a house. Roberto then pointed <br />out that Braun lntertec perl"ormed soil borings in May of 2001 on this property <br />and verified that soil replacement is necessary. Roberto also referred to the <br />City Planner's report confirming the low/wet land on the eastern portion of the <br />lot, indicating that that half of the lot appears to be unbuildable, and <br />recommending approval of the variance. Roberto indicated that the Watershed <br />has indicated there is no official wetland on the lot, but rather swamp deposits. <br />The Watershed has also indicated the need for a buffer to the adjacent wetland <br />area. <br />2 <br />
