MINUTES <br />CITY COUNCIL <br />FEQRUARY 27, 2002 <br />yard, and he would like to see the house meet setback requirements. Buche <br />noted that there are a lot of trees where Roberto is proposing to place the <br />house, and he would like to see the trees remain. <br />Fahey pointed out that the Buche property has a variance as it does not front on <br />an improved public street. Fahey indicated that, therefore, he feels compelled <br />to give Mr. Roberto some consideration for his variance request. Fahey stated <br />that he wanted someone more knowledgeable than him to interpret the soils <br />report and determine iPit is feasible to build a house within the required <br />setbacks. <br />Scalze pointed out that the Brawl report does not say pytings are necessary, but <br />says that soils will have to be replaced. Fahey stated that he was not sure and <br />wanted an interpretation of the Braun report. <br />Roberto indicated that the Braun report says that soils will need to be replaced <br />in the area that he is proposing to place his house. if the house is moved to the <br />east, the water table is quite high and soil replacement will no longer be a <br />feasible option. <br />Fahey felt that if the cost of pylings and additional fill for placing Che house <br />within required setbacks is cost prohibitive, then the lot becomes essentially <br />unbuildable without a variance. <br />Montour felt that the issue was determining at what point the amount of dollars <br />needed to construct a house on a lot with poor soils is too much for the <br />particular neighborhood. <br />Mr, Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2002-2-33 -TAB/,/NG ACT/ON ON TFIE ROL3ERT0 <br />VAR/ANC'E REQUE.S%' PEND/NG AN OP/N/ON FROM THE CITY <br />ENG/NEER ON THE BRAUN INTERTEC' REPORT RE/.ATLVE TO THE <br />TYPE OF CORRF,C:TIONS NECESSARY FOR CONSTRUCTION OFA <br />HOUSE W/TH/N THE REQUIRED SET/3ACK.S A.S WELL AS A COb"T <br />ESTIMATE FOR THOSE CORRECTIONS, SU73JICT TO THE <br />APPLICANT .SIGN/NG A <0-DA Y WA/VER AGREEMENT, AND <br />.SUB./ECT TO THE C/TYATTORNE3"S OP/N/ON ON THE ISSUE OF <br />HARD.SH/P <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Fahey, LaValle, Scalze, Montour, Anderson. <br />Nays (0). Resolution declared adopted. <br /> <br />
