MINUTES <br />CITY COUNCIL <br />MARCI3 13, 2002 <br />required setbacks and butFer none for the wetland, there is only a narrow strip <br />of property that could be developed. Hartigan indicated that the MN <br />Environmental Rights Act classifies wetlands as a natural resource and <br />prohibits any development that would impair, pollute, or destroy a wetland. <br />Allan stated that the DNR made it clear that this is the highest category of <br />wetland. AIIan stated that wetland equals unbuildable land. <br />Fahey suggested that the first issue is whether the property should be protected <br />from development. If not, then the City has to balance the interests of the <br />property owner with the neighborhood. Fahey stated that he would like the <br />City Attorney's opinion on the tax exempt status before making a decision on <br />these issues. If the City then agrees with the neighborhood that the property <br />should he protected, then Mr. LeTendre should address the Council on the <br />issue of development of land that has had tax exempt status. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESO/.UTLON NO. 2002-3-.i4 -TAB/ LNG ACTION ON THE REQUEST <br />THAT THE CITY PURSUE THE PURCHASE OF THE PAI_MEN <br />PROPERTY, INCI_UU/NG LOT 1 OF MID OAKS PLAT, AND <br />INSTRUCTING TILE CITYATTORNEYAND STAFF TO INVESTIGATE <br />WHEN AND hIOW THE TURN~U/ST/PALMEN PROPERTY WAS <br />CLASSIFIED AS TAa EXEMPT, AND DETERMINE WHAT THAT <br />MEANS FOR THE PROPERTY, AS WEI,I. AS WHETHER A PORTION <br />OF THE PROPERTY COULD BE SPL/T OFF FROM THE WETLAND <br />AREA AND DEVELOPED GI vEN TIIE TA,I EaBMPT <br />CI_ASSIFICA77ON <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Fahey, LaValle, Scalze, Montow~, Anderson. <br />Nays (0). Resolution declared adopted. <br />Dr. Allan appeared before the Council and showed a picture of the spotted <br />skunk that has been seen on this property. <br />RECESS At this point in the meeting, 8:54 p. m., Council took a short recess. The <br />meeting was reconvened at 9:08 p.m. <br />VOUCHERS Mr. LaValle introduced the following resolution and moved its adoption: <br />RE.S'OLUT ION NO. 2002-3-55 - APPRO SING THE VOUCHERS <br />
