MINUTES
CITY COUNCIL
MARCI3 13, 2002
required setbacks and butFer none for the wetland, there is only a narrow strip
of property that could be developed. Hartigan indicated that the MN
Environmental Rights Act classifies wetlands as a natural resource and
prohibits any development that would impair, pollute, or destroy a wetland.
Allan stated that the DNR made it clear that this is the highest category of
wetland. AIIan stated that wetland equals unbuildable land.
Fahey suggested that the first issue is whether the property should be protected
from development. If not, then the City has to balance the interests of the
property owner with the neighborhood. Fahey stated that he would like the
City Attorney's opinion on the tax exempt status before making a decision on
these issues. If the City then agrees with the neighborhood that the property
should he protected, then Mr. LeTendre should address the Council on the
issue of development of land that has had tax exempt status.
Mr. Fahey introduced the following resolution and moved its adoption:
RESO/.UTLON NO. 2002-3-.i4 -TAB/ LNG ACTION ON THE REQUEST
THAT THE CITY PURSUE THE PURCHASE OF THE PAI_MEN
PROPERTY, INCI_UU/NG LOT 1 OF MID OAKS PLAT, AND
INSTRUCTING TILE CITYATTORNEYAND STAFF TO INVESTIGATE
WHEN AND hIOW THE TURN~U/ST/PALMEN PROPERTY WAS
CLASSIFIED AS TAa EXEMPT, AND DETERMINE WHAT THAT
MEANS FOR THE PROPERTY, AS WEI,I.
