MINUTES <br />CITY COUNCIL <br />MARCH 27, 2002 <br />PALMEN The City Administrator reported that the attorney representing Mr. Palmen, <br />PROPERTY George LeTendre, has informed the City that the property has been sold and <br />that the County is in the process of reclassifying the developable portion of the <br />property as taxable. The attorney has also indicated that the new owner will <br />begin to remove brush from the property to prepare it for development. The <br />City Administrator reported that in response to this letter, he sent a letter to <br />Mr. LeTendre informing him of the City's tree preservation ordinance as well <br />as the fact that the City has acted on no development plan for this property. <br />The letter also outlines the fact that there is a no disturb zone around the <br />wetland area. The City Administrator recommended that the Council call for a <br />moratorium on this property until the issue of potential acquisition of the site <br />as open space by the City can be resolved. <br />Fahey indicated that he did not want to see trees and brush removed for this <br />property given the City's study of the acquisition of the property as open <br />space. He also noted that there are issues with the impact that Williams <br />Pipeline has on the area. There are also issues related to required setbacks <br />from the wetland. All these issues have a major impact on the amount of <br />developable land there maybe on the site. Therefore, a comprehensive review <br />of this property must be done. <br />The City Administrator indicated that these issues have also been <br />communicated to the County for consideration in their re-evaluation of the <br />assessed value of the property. <br />Scalze asked if the City should obtain its own appraisal of the property. The <br />City Administrator pointed out that the City Attorney is researching the issues <br />related to this property and will be reporting at the April 10°i Council meeting. <br />He suggested that actions other than calling for the moratorium be delayed <br />until that meeting. <br />The City Attorney indicated that he is researching the issues related to the <br />taxable status of the property and will be reporting on April 10°i. <br />Mr. LaValle introduced the following resolution and moved its adoptiom <br />RESOLUTION NO. 2002-3-77 -ADOPTING INTERIM ORDINANCE NO. <br />530 FOR A PERIOD OF SIX MONTHS ESTABLISHING A <br />MORATORIUM ON DEVELOPMENT OF THE TURNQUIST/PALMEN <br />PROPERTY WITHIN THE CITY OF LITTLE CANADA <br />The foregoing resolution was duly seconded by Fahey. <br />Ayes (5) LaValle, Fahey, Scalze, Anderson, Montour. <br />Nays (0).
