Staff will be preparing a text amendment to modify this <br />section of the code. <br /> <br />This interim use permit may not be utilized for the off-site storage of motor vehicles or parts <br />of motor vehicles. Quality Contracting uses the off-site outdoor storage area for <br />construction equipment and materials. <br /> <br />The owner of the storage material owns and operates a business (the “operator”) in Little <br />Canada zoned I-1, Light-Industrial, or I-P, Industrial Park. Quality Contracting is located <br />adjacent to the subject parcel to the south. Quality’s building is zoned I -1, Light Industrial <br />(although a portion of their property adjacent to South Owasso Boulevard is zoned I-P, <br />Industrial Park). <br /> <br />The location of the off-site storage is zoned I-1 (the “off-site location”). The subject parcel is <br />zoned I-1, Light Industrial. <br /> <br />The storage area meets all of the conditions for outdoor storage listed in Section 914.040.G as <br />if it were accessory to the principal use on the subject parcel, with the exception of <br />914.040.G.4 of this Ordinance. The storage area proposed complies with the conditions. <br /> <br />Both the operator’s parcel and the off-site location are found to be in full compliance with all <br />applicable zoning regulations at the time of application, and have had no history of zoning <br />violations in the previous twelve (12) months. City staff conducted an inspection in June for <br />renewal of the outdoor storage license at 3164 Spruce Street. At that time, no violations <br />were present. Additionally, city staff is not aware of any other zoning code violations at this <br />property within the previous 12 months. <br /> <br />The owner of the property and the owner of the storage material execute a development <br />agreement with the City specifying any additional conditions for use and operation of the <br />storage area, including a termination date for the interim use permit not more than five (5) <br />years from the date of approval. Upon approval, city staff will have a Development <br />Agreement prepared for Mr. Rossow and Quality Contracting to sign. <br /> <br />The previous Interim Use Permit for Mr. Rossow at 3164 Spruce Street expired in August 2015. City <br />staff during the renewal of the outdoor storage licensing caught the oversight for not having this <br />permit renewed sooner. It would be city staff’s recommendation that the request for the IUP to be <br />reissued for this property be back dated to the expiration date of the previous permit since there was <br />no lapse in use. That would mean that Mr. Rossow’s IUP would be issued from August 25, 2015 to <br />August 25, 2020. <br />Based on the above, city staff is recommending approval of a five (5) year Interim Use Permit from <br />August 25, 2015 to August 25, 2020 at 3164 Ryan Lane to allow Quality Contracting (Q3) off-site <br />outdoor storage of construction equipment and materials subject to compliance wit h the <br />recommendations in this report.
