MINl7TLS <br />CITY COUNCIL <br />APRIL 10, 2002 <br />A member of the audience suggested that liquor license fees be based on <br />percentage of liquor sales. LaValle pointed out that the courts have determined <br />that liquor license fees cannot be based on sales. <br />Mr. Anderson introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2002-4-RO -INCREASING ON-S'AI_E LI~DOR <br />LICENSE FEES TO $3,250 PER YEAR FOR THE LICENSE YEARS 2002 <br />AND 2003 <br />The foregoing resolution was duly seconded by Fahey. <br />Ayes (5) Anderson, Fahey, Scalze, Montour, LaValle. <br />Nays (o). Resolution declared adopted. <br />PALMEN Fahey noted the City Attorney's report dated April 5, 2002 relative to the <br />PROP[SRTY reclassification of the 'i'urnquist/Palmen property to taxable. The City <br />administrator indicated that the reclassification is currently being completed <br />by the County. They are also in the process of determining how many years <br />they can go back and collect property taxes on this land. <br />Fahey indicated that the Comity's reclassification of this property as taxable <br />land brings back the issue of how much of the land is developable subject to <br />compliance with the City's codes. Fahey also noted that the City currently has <br />a moratorium on this property in order to allow the Council time to study these <br />issues. Fahey indicated that while the ordinance is in place there can be no <br />disruption of the property in terms of excavation, removal of trees and <br />vegetation, etc. <br />George LeTendre, attorney representing Mr. Palmen, indicated that any <br />removal of vegetation fi'om this site would be only in the area where a road <br />could be developed. LeTendre indicated that he lrnows of nothing in the <br />moratorium ordinance that would prohibit the removal of vegetation where a <br />proposed road would be located. LeTendre indicated that his client is waiting <br />to see what the Council does before deciding how he will approach the issue. <br />LeTendre indicated that in 1999, Mr. Palmen brought forward a concept <br />development proposal for this land that was reviewed by the Parks & <br />Recreation Commission, the Planning Commission, and the City Council. <br />This concept plan was approved for 18 single-family lots. As part of the <br />concept plan, 23 acres would be dedicated to the City at no cost. LeTendre <br />indicated that the Parks & Recreation Commission had indicated that the <br />property that would be dedicated to the City would be used for a boardwalk or <br />observation deck LeTendre noted that the City Planner, City Engineer, and <br />Fire Department all looked at the concept plan and approved it as proposed, <br />
