NCINUT~S <br />CITY COUNCIL, <br />APRIL 10, 2002 <br />Commission on whether or not the entire or a portion of the site should be <br />acquired by the City. <br />LeTendre again noted that the Parks & Recreation Commission reviewed the <br />1999 concept plan and expressed interest in the wetland area of this property <br />f'or a boardwalk. <br />Scalze noted that the concept plan would likely have to be adjusted based on <br />the high water mark and the application of shoreland ordinance requirements. <br />Scalze suggested that once that is done, the purchaser may not be able to get <br />enough Tots to make development of this property worthwhile. Scalze <br />suggested that it would be difficult at this point to determine the location of a <br />road to serve however many lots could he developed on the site. <br />LeTendre indicated that there is only one place to put a road. LeTendre again <br />asked if the moratorium ordinance prohibits the removal of vegetation for a <br />road. <br />The City Administrator indicated Chat a letter was sent to Messrs. LeTendre <br />and 1'alnien informing them that no trees or vegetation can be removed from <br />the property given the City's further study of the issues related to this property. <br />The City Administrator also noted that the property owner has no development <br />approvals, therefore, clearing land for a road would be premature. <br />Fahey suggested that if h ees or vegetation are removed from the property, he <br />would expect that the City Attorney, City staff, and the Sheriff's Department <br />would aggressively enforce the City's ordinances. Fahey suggested that if the <br />Council considers a development proposal, he would expect that all aspects of <br />that proposal would meet the City's code requirements. Fahey stated that he <br />was not interested in maximizing the development of this property, and he <br />would expect that development would occur with large lots rather than small <br />ones. <br />LeTendre indicated that the concept plan the City approved in 1999 had <br />15,000 square foot lots. <br />Anderson asked if the purchaser of the property is anticipating proposing a <br />plan similar to the 1999 concepC plan. <br />LeTendre indicated that most likely the plan would be similar, and the <br />property owner realizes the need to comply with shoreland regulations and <br />provide a buffer zone to the wetland. LeTendre indicated that "but for" the <br />previous concept proposal for townhomes on this propei~Cy, the neighborhood <br />would not have turned out as it has recently. <br />
