<br /> <br /> STAFF REPORT <br /> <br /> <br /> <br />TO: Planning Commission Members <br /> <br />FROM: Jessica Jagoe, Associate Planner <br /> <br />DATE: September 6, 2017 <br /> <br />RE: 3164 Ryan Lane – Reissue Interim Use Permit, Lee Rossow & Quality Contracting (Q3) <br /> <br />On May 28, 2008, the City of Little Canada approved an Interim Use Permit for Lee Rossow at 3164 <br />Ryan Lane. The city code at that time stated that an interim use permit could not be for more than <br />one year from the date of approval. This code provision was amended shortly thereafter to allow for <br />up to five years (which is the current code language). Mr. Rossow was reissued his IUP on August 25, <br />2010, for a five year permit that allowed Quality Contracting at 3066 Spruce Street off-site storage of <br />construction equipment and materials at 3164 Ryan Lane. <br />Mr. Rossow is seeking to have the IUP at 3164 Ryan Lane reissued for another five year period. Mr. <br />Rossow has included with his application an updated site plan that shows the layout of the outdoor <br />storage that exists on the property. It should be noted that Mr. Rossow does have a Conditional Use <br />Permit that allows for accessory outdoor storage to tenants of the building which at this time is <br />Balta’s Towing. In 2008, the building was divided up between two tenants who each had designated <br />outdoor storage areas. One of those tenants moved out and Balta’s Towing now occupies the entire <br />building. With the prior tenant leaving, Mr. Rossow did allow Quality Contracting to increase their <br />off-site outdoor storage area since Balta’s did not need any additional space. <br /> <br />City Code allows off-site outdoor storage by IUP under the following conditions (staff comments <br />inserted in italics): <br /> <br />914.045. INTERIM USES (Requires an interim use permit based upon procedures set <br />forth in and regulated by Section 921 of this Ordinance.) <br /> <br />Off Site Outdoor Storage, provided that: <br /> <br />Off-site outdoor storage shall require a license in addition to any other business or outdoor <br />storage license required by the City. This separate IUP licensing provision has not been the <br />practice for how staff has handled outdoor storage in the past. The properties with an <br />Interim Use Permit have already obtained the City’s outdoor storage license as required by <br />ordinance. It seems redundant that both Owners would be required to have a license for <br />outdoor storage on their site, but also outdoor storage on the neighboring property. The <br />City has the same avenue for revocation of the outdoor storage licensing if violations occur
