MINUTES <br />CITY COUNCIL <br />MAY 7, 2002 <br />decides to purchase the property, that decision should be made based on all the <br />facts. <br />Pugaczewski pointed out that additional development will raise water levels <br />and increase the size of the wetland. Therefore, a wetland delineation should <br />take into account the effects of proposed development. Fahey noted that the <br />Watershed will he responsible for reviewing any delineations that are done on <br />the property. They have indicated that they want to see a summer delineation. <br />Pugaczewsl<i again noted that should a pipeline rupture occur, the petroleum <br />will (low into the wetland area and eventually into Gervais and the chain of <br />lakes. <br />Fahey noted that the City will Irnow the exact location of the pipeline as well <br />as the edge of the easement as a part of any development review. <br />Hageman agreed that the Council should not act without information. <br />However, he questioned waiting for the developer to provide that information. <br />Hageman pointed out that the neighborhood is requesting the property be <br />acquired for park and open spaces, and suggested that the City order an <br />appraisal based on that request. Hageman again stated that he did not believe <br />the property was developable without variances. <br />Fahey pointed out that the City does not have the right to enter onto this <br />property to do a wetland delineation or the survey work needed to determine <br />the location of the pipeline easement. Fahey also pointed out that the <br />Watershed will not do a fw~ther review of this property unless a development <br />proposal is submitted. Fahey indicated that at some point, the City will have <br />all the information. Once the City has a development proposal, it will be better <br />equipped to determine a property value and can then move forward. <br />Murial Bianchi stated that she appreciated the fact that the Cowicil appears <br />willing to consider all the different aspects of this matter. Bianchi stated that <br />the neighborhood would like to see the property as park and open space, but iC <br />does belong to someone who has the right to develop iC in accordance with the <br />City's codes. Bianchi pointed out that both the wetland and the highland are <br />all part of an ecological system that goes together. Bianchi also noted that the <br />residents of this area live with Williams Pipeline in their backyards. Bianchi <br />pointed out the many children in the area and urged the Council to consider the <br />safety issues of constructing a road near this pipeline. <br />Palley pointed out that any construction would occur outside the pipeline <br />easement area. Bianchi was concerned that large equipment working in the <br />area would cause the ground to move affecting the pipeline. <br />6 <br />
