<br /> <br /> STAFF REPORT <br /> <br /> <br /> <br />TO: Mayor Keis and Members of the City Council <br /> <br />FROM: Joel Hanson, City Administrator <br /> <br />DATE: November 17, 2017 <br /> <br />RE: PUD Extension - Cash for Houses, LLC <br /> Winter Estates, 2736 & 2744 Rice Street <br /> <br /> <br />Todd Franzen, Cash for Houses, LLC, was granted PUD approval on November 30, 2016 for the <br />proposed townhome development at 2736 & 2744 Rice Street. (The final plat was approved this past <br />spring.) Since that time, Mr. Franzen has been working on completing several of the Development <br />Agreement items that were necessary prior to construction commencing. Some of the items have taken <br />longer than originally anticipated and Mr. Franzen is requesting an extension on the PUD Approval in <br />order to allow additional time in completing the outstanding items which are: <br />• Contracts for Required Improvements <br />o Curbing <br />o Street Lighting <br />o Establishment of Vegetation which includes landscaping and fencing as required <br />as part of the PUD approval <br />• Letter of Credit based upon the Contracts for Required Improvements <br />• Verification that the required improvements discussed in the contract documents meets <br />our conditions of approval. <br /> <br />Our city code states that an applicant one year from the date of approval to commence construction or <br />they need to request an extension to allow additional time. The following is the code language for <br />Ordinance 923 PUD, Administration, Section D.4: <br /> <br /> 4. Limitation on Final Plan Approval. Within one (1) year after the approval of a Final Plan <br />for PUD, or such shorter time as may be established by the approved development schedule, <br />construction shall commence in accordance with such approved plan. Failure to commence <br />construction within such period shall, unless an extension shall have been granted as <br />hereinafter provided, automatically render void the PUD permit and all approvals of the PUD <br />plan and the area encompassed within the PUD shall thereafter be subject to those provisions <br />of the Zoning Ordinance, and other ordinances, applicable in the district in which it is located. <br />In such case, the Council shall forthwith adopt an ordinance repealing the PUD permit and all <br />PUD approvals and re-establishing the zoning and other ordinance provisions that would <br />otherwise be applicable. The time limit established by this paragraph may, at the discretion of <br />the Council, be extended for not more than one year by ordinance or resolution duly adopted. <br />
