STAFF REPORT

TO: Mayor Keis and Members of City Council

FROM: Joel Hanson, City Administrator

DATE: December 15, 2017

RE: LMCIT Liability Coverage Waiver

The Council must decide if it wishes to continue to not waive the City’s statutory tort limits for
liability coverage. By not waiving our statutory tort limits, we are telling the League of
Minnesota Cities Insurance Trust that any claims where statutory limits of liability apply will be
governed by those limits, i.e. $500,000 per person and $1.5 million of liability coverage. These
limits had been increased over the past number of years in an attempt to prevent them from being
legally changed.

In 2015, LMCIT increased the liability limit to those potential claims not covered by statutory
limits of liability to $2 million (Federal civil rights claims are one example).

Staff would recommend continuing our practice of not waiving our statutory tort limits.
