<br /> <br /> STAFF REPORT <br /> <br /> <br /> <br />TO: Mayor Keis and Members of City Council <br /> <br />FROM: Joel Hanson, City Administrator <br /> <br />DATE: December 15, 2017 <br /> <br />RE: Revisions to Hoggsbreath License Conditions <br /> <br />As you will recall, we adopted a number of conditions for the Hoggsbreath bar that outline operation <br />and security requirements for days music events were occurring (Friday, Saturday, and holiday eve <br />nights). An additional condition was to address the non-event nights so procedures were in place <br />seven days a week. Staff met with the owners of the Hoggsbreath on November 28th to discuss <br />modifications to the conditions to address that requirement. <br />Based upon that meeting, staff prepared the Revised Conditions that are attached to this memo. <br />Changes are highlighted in red and consist of the following: <br />• Security Staff for “event nights” remains at 12 people. Staffing for other nights was added <br />based on Hoggsbreath’s current operation. <br />• Added a comment to the Security Clothing provision that acknowledges that yellow or orange <br />reflective vests labeled “SECURITY” meet the intent of the clothing provision. <br />• Added language that states the dress code is enforced from 9:00 p.m. until closing on a daily <br />basis. <br />• Deleted the condition that required us to prepare these modifications. <br />It should also be noted that Hoggsbreath has requested two additional modifications to the conditions <br />that I did not make but noted with yellow highlighting. They are: <br /> They would like to reduce the number of security personnel dedicated to the parking lot patrol <br />from two to one from November through April due to the weather limiting activity during that <br />part of the year. <br /> They have asked that music be allowed to continue until 1:45 a.m. instead of 1:30 a.m. They <br />initially felt the 1:30 time would allow people to leave the premises more gradually once music <br />stopped. What they have experienced is most of the crowd leaving as soon as the music is <br />discontinued. They feel this is impacting business. <br />There was also the issue of the Security camera footage to be retained for at least 10 days. An incident <br />on October 7th did not follow that requirement in that the recording was overwritten five days later. In <br />discussing this with Mr. Duray, he informed me that he has ordered a new recorder that will have <br />capacity for about 30 days storage. I have attached the sales receipt for your review.
