STAFF REPORT

TO: Mayor Keis and Members of City Council

FROM: Jessica Jagoe, Planning Associate

DATE: January 19, 2018

RE: 3100 Country Drive – Schwalbach PUD Amendment Extension
Jim Schwalbach had applied for a PUD Amendment in August 2017 for his property at 3100 Country
Drive. The City Council denied this request at the August 23, 2017 meeting with the recommendation
that a workshop be held with the Planning Commission and City Council to discuss non-tenant outdoor
storage. Additionally, the resolution allowed the applicant the option to reapply within six months
with the fee waived. That six month deadline would be February 2018.
RESOLUTION 2017-8-144 – DENYING THE PUD AMENDMENT TO ALLOW OUTDOOR RENTAL SPACE FOR
NON-BUILDING TENANTS AT 3100 COUNTRY DRIVE, BASED ON THE REASONS THAT THE CURRENT
SITUATION HAS WORKED WELL FOR 10 YEARS WITH NO COMPLAINTS AND THE COUNCIL DOES NOT
WANT TO REVERT BACK TO THE PROBLEMS THERE USED TO BE WITH OUTDOOR STORAGE; WITH THE
CONDITION THAT IF THE APPLICANT REAPPLYS FOR A RELATED REQUEST WITHIN 6 MONTHS, THE
PLANNING FEE WOULD BE WAIVED
The workshop was originally scheduled for October along with the Comprehensive Plan discussion,
but was tabled until January 10, 2018. Based on the workshop discussion, city staff will be preparing
an ordinance amendment for review in February or March. Afterwards, Mr. Schwalbach would be
able to reapply based on the ordinances amendments approved. With this delay and to provide Mr.
Schwalbach time to reapply, city staff is recommending the City Council approve a six month
extension to resolution 2017-8-144.
