Date N/A Current Amendment Amount: -$217,233.66 <br /> Current Contract Total 1,145,832.23 <br /> <br /> <br />Project Identification : City of Little Canada replacement of active highway-rail grade warning safety devices <br />State Project (SP): 62-00211 Trunk Highway #: NA <br />Federal Project # RRS 6215(102) <br /> <br />This amendment is by and between the State of Minnesota, through its Commissioner of Transportation (“State Entity”) <br />and <br />the City of Little Canada, Minnesota, a Plan A statutory city, ("Grant Recipient"). <br />Recitals <br />The State Entity has a contract with the Grant Recipient identified as MnDOT Contract No. 06820 (“Original Contract”) <br />to provide a Construction Grant for the City of Little Canada to replace active highway-rail grade warning safety devices <br />that have reached the end of their useful life and to design, construct and equip highway-rail grade crossing warning <br />devices and associated safety improvements. <br />The Original Contract is being amended because the actual cost of the project came in lower than the Engineer’s Estimate. <br />The State and the Grant Recipient are willing to amend the Original Contract as stated below. <br />Contract Amendment <br />In this Amendment deleted contract terms will be struck out and the added contract terms will be underlined. <br />REVISION 1. All references to “Attachment III” are deleted and replaced with “Attachment IIIA.” <br />REVISION 2. Article VI, Section 6.23 is amended to read: <br />Section 6.23 Matching Funds. The Grant Recipient must obtain and supply the following matching funds, if <br />any, for the completion of the Project: <br /> <br /> <br />City general funds will be used to provide the Matching funds in the amount of $83,104.00. NONE <br /> <br />Any matching funds which are intended to meet the above requirements must either be in the form of (i) cash monies, (ii) <br />legally binding commitments for money, or (iii) equivalent funds or contributions, including equity, which have been or <br />will be used to complete or pay for the Project. The Grant Recipient shall supply to the Commissioner of Management <br />and Budget whatever documentation the Commissioner of Management and Budget may request to substantiate the <br />availability and source of any matching funds, and the source and terms relating to all matching funds must be consented <br />to, in writing, by the Commissioner of Management and Budget. <br />REVISION 3. ''Attachment III'' to the Original Contract is deleted in its entirety and replaced with "Attachment IIIA", <br />which is attached and made a part of the Original Contract. <br />
