<br /> <br /> <br /> <br /> <br /> <br /> <br />The survey submitted shows that the existing structures (i.e. house and attached garages) for both <br />parcels at 2320 Preserve Trail and 475 Viking Drive do comply with setback requirements for R-1 <br />single family residential after splitting off a portion of the property and adjusting the side yard property <br />line (along 475 Viking Drive) to create the new lot adjacent to the two. <br /> <br />Easements. The certificate of survey submitted by the applicant does not show the required six foot <br />drainage and utility easements around all three parcels. This will be a condition of approval and the <br />applicant shall be required to submit a new survey showing this dedication. <br /> <br />It should be noted there is an existing six foot drainage and utility easement around the east, north, and <br />west elevations on the 2320 Preserve Trail parcel as it exists today with the current lot line <br />configuration. However, with the lot line adjustments being proposed this will impact this easement <br />on the west side of the property. Also, the survey submitted by the applicant has shown that an <br />existing 12 foot drainage easement for Parcel B, 475 Viking Drive, at the southwest corner of the lot <br />will be vacated. The applicant will need to apply to have these easements vacated and approval of the <br />Simple Subdivision would be subject to approval of the vacation. <br /> <br />Lastly, there is a 20 foot MnDOT Storm Sewer Easement that runs north to south on 2320 Preserve <br />Trail and the newly created Lot C. The applicant is aware of this easement and staff has chatted with <br />him about taking this this into consideration in his plans for construction of a new home on Parcel C. <br />There is no additional setback requirement from the easement, but the applicant is aware that he is not <br />allowed to build anything within this easement. The storm pipe within this easement is very deep and <br />the City Engineer is reviewing this in greater detail. Planning staff is recommending a condition of <br />approval be subject to any comments or conditions of the City Engineer following his review. <br /> <br />Park and Trail Dedication. As a condition of lot split, it is recommended that the new Parcel C be <br />subject to the City’s park and trail dedication/cash contribution requirements payable at the time of <br />construction. <br /> <br />Grading, Drainage & Utilities. The City Engineer has confirmed the need for drainage and utility <br />easements along all lot lines for all three parcels. It is also his recommendation that the applicant be <br />required to submit a grading plan to verify that the drainage from each lot will be conveyed within the <br />provided drainage and utility easements prior to issuing any building permit. <br /> <br />The Public Works Director has noted that there is only a sewer connection available to the newly <br />created lot. Therefore, the applicant will be required to install a new water service connection for the <br />lot as a result of the proposed lot split. The installation of this service will require work being <br />performed in the street. The applicant will be required to install this service subject to the <br />specifications as outlined in Section 1601, Municipal Water System. In addition, the repair work that <br />is completed to the City street as a result of these services being installed must meet city street <br />standards as outlined in Section 502, Street Construction Specifications. <br /> <br /> <br /> <br /> Setback Requirement <br />Front Yard Not less than 30 feet <br />Side Yard 7 ½ feet <br />Rear Yard Not less than 30 feet
