CITY OF LITTLE CANADA <br />RAMSEY COUNTY <br />STATE OF MINNESOTA <br />ORDINANCE NO. 828 <br /> <br />AN ORDINANCE AMENDING CHAPTER 1001 OF THE LITTLE CANADA CITY <br />CODE, KNOWN AS THE SUBDIVISION ORDINANCE. <br /> <br /> <br />SECTION 1. The City Council of the City of Little Canada hereby amends Section 1001, <br />known as Subdivision Ordinance, General Provisions, to modify Section 1001.060, by adding the <br />underlined material and deleting the stricken material as follows: <br /> <br /> <br />1001. GENERAL PROVISIONS <br /> <br />1001.060. EXCEPTIONS. When requesting a subdivision, if the following condition or <br />conditions exist, the City Administrator shall deem the request to be a “simple subdivision” and <br />exempt the subdivider from certain procedural provisions as directed in this section. <br /> <br />A. In the case of a request to divide a lot where the division is to permit the adding of a <br />parcel of land to an abutting lot or to create three (3) or less lots and the newly created <br />property line will not cause the other remaining portion of the lots, or any structures <br />within the subdivision, to be in violation with this Ordinance or the Zoning Ordinance, <br />then the City Administrator shall place the request on the agenda of the Planning <br />Commission for recommendation to the City Council, subject to the City’s scheduling <br />requirements. Said subdivision may be exempted from other procedural or data <br />requirements as deemed appropriate by the City Administrator. <br /> <br />B. Any parcel resulting from a subdivision with a metes and bounds description shall not <br />thereafter be subdivided again with a new metes and bounds description while it is under <br />the same ownership or for a period of 10 years from the date of final approval by the <br />City; whichever time period is greater. Any subsequent subdivision for such parcels done <br />prior to this time period shall be by plat only, in accordance with the requirements of <br />Section 1004 of the City’s Subdivision Ordinance, without the exceptions otherwise <br />allowed by Section 1001 or Section 1009. <br /> <br />B C. In the case of a request to combine two or more lots of record, where there exists a total <br />of no more than one (1) building on all lots subject to the request, and which request will <br />not cause other parcels or structures to be in violation of this Ordinance or the Zoning <br />Ordinance, then the City Administrator may certify that the procedural requirements of <br />the subdivision ordinance do not apply to the request, exempting the subdivider from the <br />requirements for Planning Commission recommendation and City Council approval. <br />Such certification shall be made within ten (10) days of the receipt of this request. <br /> <br />
