MINUTES <br />CITY COUNCIL <br />AUGUST 28, 2002 <br />Canada was considered to be fully developed. Fahey noted that this is <br />likely the same reason the City of Roseville does not have an ordinance. <br />Anderson stated that he would like to know how many times the City of <br />Maplewood has denied a building project and enforced the ordinance, or if <br />theyjust approve all projects regardless of the setback. <br />Fahey stated that he would like to give the Williams Pipeline people a <br />chance to comment on the issue as well. He also suggested that perhaps <br />the City could hear from a representative from the City of Maplewood on <br />this issue. <br />Anderson felt that if Little Canada is going to consider adopting a city- <br />wide ordinance, he would like to know how many pieces of property are <br />affected by the ordinance. Anderson suggested that if the Palmen property <br />is the only piece of undeveloped land affected by this ordinance, the issue <br />of a taking becomes even more significant. <br />Fahey felt that the public safety issue was significant enough that the City <br />could adopt an ordinance that contains reasonable standards that allows for <br />variances if the situation warranted. Fahey felt that additional <br />information was needed before the Council could make a decision on the <br />request for a setback ordinance. <br />The City Administrator pointed out that it will take Williams Pipeline 60 <br />to 90 days to review The Preserve Preliminary Plat. The moratorium on <br />the Palmen property will expire in mid-September, that the City <br />Administrator recommended that the moratorium be extended at the <br />Council's next meeting. Fahey recommended that the moratorium <br />extension include the public safety issue. Fahey suggested that action on <br />the request for the pipeline setback ordurance be tabled for 30 days <br />pending additional information. <br />Mrs. Scalze introduced the following resolution and moved its adoption: <br />RESOI UTION NO. 2002-R-20G -TABLING ACTION ON THE <br />REQUEST FOR A PIPELINE SETBACK ORDINANCE UNTIL THE <br />SEPTEM73ER 25, 2002 REGULAR COUNCIL, MEETING PENDING <br />RECEIPT OF THE ADDITIONAL INFORMATION DISCUSSED <br />THIS EVENING <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Scalze, LaValle, Fahey, Anderson, Montour. <br />Nays (0). Resolution declared adopted. <br />14 <br />
