STAFF REPORT TO: Mayor Keis and Members of City Council FROM: Heidi Heller, City Clerk DATE: July 6, 2018 RE: Call for a Closed Session to Consider Sale of City-Owned Vacant Parcel on Market Place Drive The Mayor received an updated offer by email on June 29, 2018 to purchase the vacant parcel on Market Place Drive. The buyer was told that the City Council would need to discuss the offer and their next meeting was on July 11. The parcel is 0.62 acres and the dimensions are 152.44 feet x 178.73 feet (27,245 square feet). The County has given this parcel an estimated market value of $218,000. Staff is recommending the Council go into closed session to discuss a purchase offer for the above referenced property. We may close a meeting to discuss this offer pursuant to Minnesota Statutes 13D.05, subd. 3(c). This statute allows us to close a meeting to “develop or consider offers or counteroffers for the purchase or sale of real or personal property”. To close the meeting to consider this matter, we need to comply with the following steps: • Before closing the meeting, the council must state on the record the specific grounds for closing the meeting, describe the subject to be discussed, and identify the particular property that is the subject of the meeting. • The meeting must be tape-recorded and the property must be identified on the tape. The recording must be preserved for eight years, and must be made available to the public after all property discussed at the meeting has been purchased or sold or after the public body has abandoned the purchase or sale. • A list of councilmembers and all other persons present at the closed meeting must be made available to the public after the closed meeting. • The actual purchase or sale of the property must be approved at an open meeting, and the purchase or sale price is public data. The Council should provide direction as to how they would like to proceed with this offer.
