Page 1 of 4 <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />EASEMENT AGREEMENT <br /> <br /> This Agreement is made effective this ____ day of August, 2018 by and between Foley <br />Properties Sta LLC , a Minnesota limited liability company, Grantor and City of Little Canada, a <br />Municipal Corporation under the laws of the State of Minnesota, Grantee. <br /> WHEREAS, Grantor is the owner of real property situated in the County of Ramsey, State of <br />Minnesota legally described as follows to wit: <br /> That part of the South 232.50 feet of the Northwest Quarter of the Northwest Quarter of <br />Section 6, Township 29 North, Range 22 West, Ramsey County, Minnesota which lies Easterly of <br />the Easterly right – of – way line of the Soo Line Railway and which lies West of the East 260 feet of <br />said Northwest Quarter of Northwest Quarter, according to the United Government Survey thereof. <br />“Parcel A”: and <br /> WHEREAS, the Grantee is the fee owner of real property situated in the County of Ramsey, <br />State of Minnesota, legally described as follows, to-wit: <br /> Described on Exhibit A attached hereto (“Parcel B”), and; <br /> WHEREAS, the only means of access to Parcel B is over and across the road presently <br />located along the westerly portion of Parcel A. <br /> NOW, THEREFORE, in consideration of the mutual benefits derived here from, Grantor on <br />behalf of itself its successors and assigns hereby conveys to Grantee its successors and assigns, a <br />nonexclusive perpetual easement of ingress and egress by vehicular and pedestrian traffic at any and <br />all times. In addition, Grantor on behalf of itself, its successors and assigns hereby conveys to <br />Grantee its successors and assigns a non-exclusive perpetual easement to construct, repair, maintain <br />and replace private and public utility facilities including but not limited to power, <br />telecommunications, water and sewer. Said easement shall run over, under and upon that part of <br />Parcel A described as follows: <br />A 33.00 foot wide perpetual easement for ingress/egress purposes, over and across that part <br />of the south 232.50 feet of the Northwest Quarter of the Northwest Quarter of Section 6, <br />Township 29 North, Range 22 West, Ramsey County, Minnesota, which lies easterly of the <br />easterly right-of-way line of the Soo Line Railway and which lies westerly of the easterly <br />260.00 feet thereof.
