<br />refuse container(s) may be located within the approved outdoor storage area subject to <br />compliance with the screening requirements in 914.040.G.9. <br /> <br />The waste containers are located on the east side of the building screened by a wood fence. <br />During the inspection completed in June there was a construction dumpster in the drive <br />aisle outside of the outdoor storage area on the east side of the building. Mr. Leahy <br />indicated this on the site temporarily for cleaning out old product/junk/debris from the rear <br />yard. This dumpster was still present on the property today. This construction dumpster <br />needs to be removed from the property within 15 days (since it has been on site since June <br />staff feels amply time has been given) or moved inside the approved outdoor storage area. <br /> <br />12. The storage area shall be paved with asphalt, concrete, or other material approved by the <br />City Council. <br /> <br />The proposed outdoor storage area on the west side of the building is paved. <br /> <br />13. The storage area shall not occupy any space required for conformity to the parking <br />regulations of the Zoning Ordinance. <br /> <br />The proposed outdoor storage area does impact four parking spaces that were shown on <br />the 1999 CUP. City staff from previous inspections can confirm this area on the west side <br />of the building has not been needed for employee or customer parking. <br /> <br />City staff has received a Proof of Parking plan from Mr. Leahy that does show where four <br />additional parking spaces could be established on the east side of the property. Proof of <br />Parking is subject to the conditions of 903.050.H.30 - <br /> <br />903.050.H.30 - Proof of Parking. The City Council may approve a reduction in the actual number <br />of spaces to be constructed accessory to any use by the approval of a Conditional Use Permit, per <br />the requirements of Section 921.030 of this Ordinance. A Conditional Use Permit for such a <br />reduction shall be allowed only where an applicant can demonstrate the following: <br /> <br />a. The demand for parking actually needed by the proposed use will be less than ninety <br />(90) percent of the requirement which applies under this Ordinance; <br />b. Based upon an appropriately designed site plan the required number of spaces may be <br />constructed at some future date on the subject site in full conformance with all other <br />requirements of the City’s Zoning Ordinance and Building Code; <br />c. The applicant and City enter into a development agreement, to be recorded against the <br />subject property, which includes a clause requiring the owner to install the additional <br />parking stalls, upon a finding by the Planning Commission that such additional parking <br />stalls are necessary to accommodate the use; <br />d. A change of use will necessitate either a new application for a “Proof of Parking” <br />Conditional Use Permit, or compliance with the applicable Zoning Ordinance standard <br />for parking. <br />
