<br /> <br /> STAFF REPORT <br /> <br /> <br /> <br />TO: Planning Commission Members <br /> <br />FROM: Jessica Jagoe, Associate Planner <br /> <br />DATE: October 5, 2018 <br /> <br />RE: 2925 Country Drive – PUD Ordinance <br /> <br />At their September 12th meeting, the City Council made the recommendation to approve the Planned <br />Unit Development Amendment at 2925 Country Drive to allow for a charter school to be permitted in <br />the PUD District. This motion included direction for city staff to prepare an ordinance amendment <br />establishing a special PUD District. The following was the City Council resolution for approval – <br /> <br />RESOLUTION 2018-9-178 - APPROVING A PLANNED UNIT DEVELOPMENT <br />AMENDMENT AT 2925 COUNTRY DRIVE TO ALLOW FOR A CHARTER SCHOOL TO <br />BE A PERMITTED USE IN THE PUD DISTRICT, AND DIRECTING CITY STAFF TO <br />PREPARE AN ORDINANCE WITH A TEXT AMENDMENT TO ESTABLISH A <br />SPECIAL PUD DISTRICT WITH THE FOLLOWING CONDITIONS: <br /> <br /> At the City’s sole discretion if it is determined that the site plan as presented does not <br />operate in the manner as described and backups or significant traffic impacts on Country <br />Drive at the access points, the Property Owner will be required to make modifications to <br />site layout that are considered satisfactory to the City which could result in improvements <br />on Country Drive. Potential layout options may include the addition of a turn lane or <br />bypass lane at the cost of the owner. <br /> Allow daytime parking of 1-2 buses <br /> A permanent play area location and permanent fencing be finalized by Fall 2021 <br /> Install a fence along the school side of the trees along the west boundary before the start of <br />the 2019 school year <br /> Install some sort of fence along the north property line to protect the adjacent parking lot by <br />Fall 2019 <br /> The applicant must sign a 60-day rule waiver (completed 9/12/18) <br /> Follow the submitted traffic study recommendations <br /> Hours and days of operation of the school are limited to the State of Minnesota education <br />requirements <br /> <br />I have included with this report a copy of the most recent site plans submitted by The Academy of <br />Sciences and Agriculture (AFSA). These site plans are slightly different than the original plans <br />reviewed by the Planning Commission in September. Modifications that were made are functioning <br />and traffic pattern of the bus pick-up and drop-off, the play area on the north side of the building, and <br />addition of a play area on east side of building. One other change to the proposal since the Planning <br />Commission meeting is how the parent pick-up and drop-off activity will occur. These changes in
