<br /> <br /> STAFF REPORT <br /> <br /> <br /> <br />TO: Mayor Keis and Members of City Council <br /> FROM: Chris Heineman, City Administrator <br /> <br />DATE: December 14, 2018 <br /> <br />RE: LMCIT Liability Coverage Waiver <br /> <br /> <br />The decision to waive or not waive the statutory tort limits for liability coverage from the League <br />of Minnesota Cities Insurance Trust (LMCIT) must be made on an annual basis by each <br />governing body. The Council must decide if it wishes to continue to not waive the City’s <br />statutory tort limits. By not waiving our statutory tort limits, we are telling the League of <br />Minnesota Cities Insurance Trust that any claims where statutory limits of liability apply will be <br />governed by those limits, i.e. $500,000 per person and $1.5 million of liability coverage. <br /> <br />If the City of Little Canada waives the statutory tort limits, it is recommended that excess <br />liability coverage be purchased. If the Council waives the statutory tort limits and does not <br />purchase excess liability coverage, a single claimant could recover up to $2,000,000 for a single <br />occurrence. If the City of Little Canada waives the statutory tort limits and purchases excess <br />liability coverage, a single claimant could recover up to the limit of the coverage purchased. <br /> <br />Staff recommends continuing our practice of not waiving our statutory tort limits. <br /> <br /> <br /> <br /> <br /> <br />
