7 <br />Section 4.1. Restrictions of Use. AFSA agrees for itself, its assigns and every successor <br />and interest to the Property or any part thereof that AFSA and such successors and assigns shall be <br />bound to the condition of use in this section in its operation of a charter school at the site. The <br />school calendar shall conform to the provisions of state law., as amended from time to time. The <br />school week shall be Monday through Friday and it shall exclude those days on which the school is <br />formally closed for national holidays or other reasons established by the school. Students shall only <br />be allowed on the Property during school days, except if their presence is for an extracurricular <br />activity or event sponsored by the school. On any school day no student shall be allowed on the <br />Property prior to 6 a.m. shall vacate the Property by 6 p.m. except if presence is due to <br />extracurricular activities or events sponsored by the school. With the exception of buses parked <br />temporarily for the purpose of dropping off and picking up students, no more than two buses shall <br />be parked on the property. <br />ARTICLE V <br />Performance Guarantees <br />Section 6.1. AFSA’a Improvements. AFSA will fully and faithfully comply with all <br />terms and conditions of any and all contracts entered into by AFSA for the installation of the <br />construction of all improvements identified on the Site Plan. <br />ARTICLE VI <br />Recording And Release <br />AFSA agrees that the terms of this Agreement shall be a covenant on any and all property <br />included in the Subdivision. AFSA agrees that the City shall have the right to record a copy of this <br />Agreement with the Ramsey County Recorder to give notice to future purchasers and owners. This <br />shall be recorded against the Property and Subdivision described on Page 1 hereof. <br />ARTICLE VII <br />Reimbursement Of Costs <br />AFSA agrees to fully reimburse the City for all costs incurred by the City in connection with <br />this Agreement including, but not limited to, engineering fees, legal fees, inspection fees, interest <br />costs, and any other costs incurred by the City relating to this Agreement and the installation of the <br />aforementioned improvements.
